Do I Need Planning Permission for an Office Fit Out?

Planning permission is one of the first worries business owners raise when they start thinking about an office fit out. The good news is that most internal fit outs do not need it at all. That said, the answer depends on what you are actually changing, and getting it wrong can lead to costly delays or enforcement action later.

We manage office fit out and refurbishment projects across Portsmouth, Hampshire and the wider South Coast, so we deal with these questions every week. Here is a clear guide to when planning permission for an office fit out is needed and when it is not.

The Short Answer

In most cases, a straightforward internal office fit out does not require planning permission. Rearranging the layout, installing new partitions, updating finishes and refreshing the space are usually treated as internal works that do not count as development in planning terms.

Where it becomes more involved is when your project affects the outside of the building, changes what the building is used for, or involves a protected building. Those are the situations to watch.

When Planning Permission Is Usually Not Needed

Internal alterations that do not affect the external appearance of a building generally fall outside the planning system. For a typical office fit out, that covers most of what you are likely to do:

  • Reconfiguring the internal layout
  • Installing or removing partitions that are not structural
  • Fitting new ceilings, flooring and lighting
  • Redecorating throughout
  • Upgrading kitchens, washrooms and breakout areas

If your project sits entirely within these boundaries, you can usually proceed without a planning application. Building regulations are a separate matter, which we cover further down.

When You Will Need Planning Permission

Planning permission is more likely to come into play when your project reaches beyond the interior. Common triggers include:

  • External changes such as new windows, doors, extensions or alterations to the front of the building
  • Plant and equipment fixed to the outside, such as air conditioning units, where they affect the external appearance
  • External signage, which is dealt with under a separate advertisement consent regime
  • A material change in how the building is used that is not already permitted

It is also worth knowing that some areas have what is called an article 4 direction, which removes certain automatic rights and means permission is needed for works that would normally be exempt. Your local planning authority can confirm whether one applies to your premises.

Change of Use and Use Class E

Since September 2020, most commercial premises in England sit within a single planning category called Use Class E. This class covers offices, shops, restaurants, gyms, medical services and more.

The practical effect is significant. Moving between uses within Class E, for example turning a former shop into an office, no longer needs planning permission. Uses that sit outside this class, known as sui generis, such as pubs, takeaways and nightclubs, still require permission to change. If your fit out involves changing the use of the space, it is worth checking which category applies before you commit.

Listed Buildings and Conservation Areas

Older and protected buildings come with an extra layer of control. If your premises is listed, you may need listed building consent even for internal works, and the bar is set high because the aim is to preserve the character of the building.

Similar care is needed in conservation areas and areas of outstanding natural beauty, where additional conditions can apply. If you occupy a building with any historic status, check the position early, because unauthorised work to a listed building is treated very seriously and there is no time limit on enforcement.

Do Not Overlook Building Regulations

This is the part that catches people out. Even when planning permission is not required, building regulations almost always are. They are a separate set of rules covering the safety and standard of the work itself, and they apply to most fit out projects.

For an office fit out, building regulations typically cover fire safety and means of escape, accessibility, electrical work, ventilation and any structural change such as removing a load bearing wall. Signing this off properly is not simply a legal box to tick, it protects everyone who uses the building. A good contractor will factor this in from the start rather than treating it as an afterthought.

What About Mezzanine Floors?

Mezzanine floors are a popular way to add usable space without moving premises, and they carry their own considerations. A mezzanine will normally need building regulations approval for fire safety, structural loading and means of escape. In some cases, particularly in retail settings above a certain size, planning permission can also be required.
